Further Proof that Elections have Consequences

May 26, 2009, President Obama placed Judge Sonya Soltomayor, currently a Justice on the United States Circuit Court of Appeals for the Second Circuit (New York), into nomination for the open seat on the Supreme Court. As expected, Judge Soltomayor is a liberal jurist who believes in the “living constitution” instead of one that is firmly founded in our nations’ values and history.First, some talking points about Judge Soltomayor:She is not the first Hispanic to be nominated to the Supreme Court. That honor went to Benjamin Cardozo (he was of Portuguese- Jewish ancestry), who was nominated by Republican Herbert Hoover.The case of Ricci v. DeStefano is currently being decided by the Supreme Court. This is a case of discrimination (some call it reverse discrimination) where a white firefighter successfully passed the lieutenant’s exam for promotion, but the results of the tests did not produce any minority lieutenant candidates, so the results were thrown out. Judge Soltomayor ruled in favor of the City of New Haven, who threw out the results of the test. It is expected that the Supreme Court will reverse that decision. This will be the rare occurrence where a nominee has been reversed while going through the nomination process.She is one of only three federal appellate judges in America to issue a court opinion saying that the Second Amendment does not apply to states. The case was Maloney v. Cuomo, and it was issued this year, in spite of the Supreme Court decision in Heller v. DC (the DC gun ban case). (thanks to the heads up from Ken Blackwell on this)The Judicial Confirmation Network states that Judge Soltomayor has a 100% reversal rate in the Supreme Court, which means that the Supreme Court has disagreed with every one of her published opinions that have reached the Supreme Court. This is an extraordinary statistic and should give pause when considering her legal acumen.Surprisingly, not all Democrats are on board with this selection. Jeffrey Rosen, legal affairs editor at the liberal New Republic wrote an article about Soltomayor. Rosen spoke with a “range of people who have worked with her, nearly all of them former law clerks for other judges on the Second Circuit or former federal prosecutors in New York. Most are Democrats and all of them want President Obama to appoint a judicial star of the highest intellectual caliber who has the potential to change the direction of the court.” Rosen reported, “nearly none of them raved about her. They expressed questions about her temperament, her judicial craftsmanship, and most of all, her ability to provide an intellectual counterweight to the conservative justices, as well as a clear liberal alternative.”Specifically on her intellect, Rosen noted, “the most consistent concern was that Sotomayor, although an able lawyer, was ‘not that smart and kind of a bully on the bench,’ as one former Second Circuit clerk for another judge put it. ‘She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren't penetrating and don't get to the heart of the issue.’”Rosen continues: “Her opinions, although competent, are viewed by former prosecutors as not especially clean or tight, and sometimes miss the forest for the trees. It's customary, for example, for Second Circuit judges to circulate their draft opinions to invite a robust exchange of views. Sotomayor, several former clerks complained, rankled her colleagues by sending long memos that didn't distinguish between substantive and trivial points, with petty editing suggestions--fixing typos and the like--rather than focusing on the core analytical issues.”While conservatives should not be happy with this selection, elections do have consequences, one of them being that the President, with a majority of votes in the Senate, can pass this nomination.However, this selection may have a disastrous consequence on the progressive movement’s attack on the Supreme Court. Right now, there are four solid conservative votes on the Court, and four solid liberal ones (even replacing Justice Souter with a Justice Soltomayor), with Justice Kennedy in the middle, who has a slight trend towards being conservative. When the Justices are deciding on a case, there is a robust debate where each side makes their points in an attempt to win support. If Judge Soltomayor is as advertised in the New Republic, namely a bully whose arguments are not very strong, she may unwittingly push Justice Kennedy to the other side, thus giving conservatives regular victories.While conservatives should oppose this nomination on philosophical grounds, her nomination may just make the Court more conservative in the long run by tightening up Justice Kennedy’s decisions.

Why Judges should not make policy from the Bench

The disdain for those who set the foundation of this nation can be found throughout Barack Obama's life and people like Judge Sotomayor. This idea that the country was founded by "old white men who owned slaves" gives license to those who want to disregard the U.S. Constitution. President Obama is on record saying several years ago he believed the Constitution is outdated. Judge Sotomayor fits into the belief system that the Constitution is a "living, breathing" document. That is a libs term for it can be rewritten from the judicial bench. The truth is the Constitution can be rewritten, but only through the amendment process. The Founding Fathers (old White males) wanted the vehicle in place for changes as the country grew but not to make it so easy to change. They were strongly concerned about a tyrannical judiciary which is what we have in America today. Judges who believe they alone know what is best for the American people. Judges who have decided they should --as Judge Sotomayor told a law class -- make "policy."

It is for the legislative branch to make the laws because it is the branch where the people have the most effect on the elected. Many Judgeships, and especially those of the U.S. Supreme Court, are lifetime appointments. This causes many problems as their is little to do to remove the Judge no matter how wrong their opinions are or how much the law is disregarded.

The role of the judiciary in America is not to make the lives of the citizens better (in the view of the Judge) but, instead, to make sure the laws approved get implemented in the proper fashion. This activist view of disregarding law is why Judge Sotomayor was overturned in 4 of 5 decisions that have gone before the U.S. Supreme Court.

That is according to a story this morning in the Washington Times. What is amazing that she is reversed, with her radical thinking, at a time when the judiciary is as liberal as it is.

Liberal Johnathon Turley blindsided MSNBC's Chris Matthews yesterday in an interview when he said he was disappointed in the appointment of Judge Sotomayor. Turley said that she doesn't have the "intellectual depth." Newsbusters.org has the full video at http://www.newsbusters.org/.

While Judge Sotomayor was hailed as a "moderate" yesterday by many in the media, it should be noted that 60% of her opinions were overruled and many because of her racial bias in the rulings. She is certainly not a moderate in the area of "affirmative action" or as Rush called her yesterday a "reverse-racist." She also isn't "moderate" in the area of environmental issues as you see in a ruling where she sided that fish must be protected from power plants.

A NYTimes columnist went after the republican party saying that Northeasterners are too smart to be duped by the GOP. While there are many good conservatives in the Northeast, we need more to stand up and be counted. The Northeast may have the highest income as mentioned in the column but they also have the higher tax structure which negates any real advantage in usuable income. The column says that people who live in the NE are better educated. This is slightly true but as Clay Waters of the Media Research Center points out, this group also has the least amount of religious faith of any region in our nation:

Then came the regional generalizations, which liberals would have probably considered offensive if directed at any other group save conservatives:
But, Northeasterners are not so easily duped. Voters there tend to be wealthier, better educated, less religious and more progressive than those in other regions.According to the Census Bureau, the median household income in most of these states is higher than the national average. And, a census report released in January revealed that 31.5 percent of Northeasterners had a bachelor’s degree or higher, more than in any other region.The American Religious Identification Survey released in March found that New England had the highest percentage of respondents who said either “none” or “no religion” when asked about faith. Nationwide, the percentage of “nones” nearly doubled from 1990 to 2008. In the Northeast, it more than doubled, and in some cases nearly tripled. “Nones” tend to be liberal and voted overwhelmingly for Barack Obama in November.


When I'm on the radio in the Northeast, I'm always interested in the fact that many think the rest of the county has it terrible. After all, they don't live in New York City or one of the major NE cities. They only see a coastal United States and the rest of the nation is "fly-over country."
What is funny about this is that when I'm on in "fly-over country" they realize that those who live in the Northeast have it bad. After all, many pay most of their salary to live in a small closet that is called an apartment and have to take a dirty subway to work and back, while many of us live in good size homes, have room to walk around in, and we get to drive our own car to work. I've found each region of the country has its unique advantages. That is why this is more than a country of those who live on the east and west coasts. It is a shame that the NE, however, has lost its religious roots. It was here that many came from European nations and landed on the shore to begin a new life of religious freedom. It was in the Northeast that the Revolutionary War was fought against the Tyranny of the King of England. New England is more like Europe than the rest of the United States and that is a shame.

Remaking America

That is a term President Obama uses often and today he went another step toward making that term a reality. Obama's appointment of Judge Sotomayor is a perfect example of the change Obama believes in. His idea of remaking America come from the mentoring of those who dislike the nation created by our founding fathers. I had a call on WBT/Charlotte the other day from a lady who said that Obama "seems so sincere" when he speaks. She went on to say that any thing in his past didn't matter because he "seems so sincere." One only has to read his book to see who Obama looked up too as a young person. I dare say that not one good role model is in that group. We are all familiar with the Church that Obama attended in Chicago, the money he gave to the racist bigotry and anti-American retoric of Rev. Jeremiah Wright. Remember also, that Obama in an radio interview several years ago saying that the U.S. Constitution is outdated. What esle do you need to know? The America that Obama envisions is one that is little resemblance to the one created by our Founding Fathers. Today's appointment of a radical leftist is example that Obama intends to impose his socialist and radical will upon the American people. If the Constitution is "outdated" then he must have those on the Supreme Court who share his views. Now, we have a judge who said that as a hispanic woman she should be smarter than white males?

I would like to point out to the judge that it was those "old white men" who wrote the U.S. Constitution and put the framework in place so that someone as herself could become a Judge one day.

Watch the video on the newsmax.com site where Judge Sotomayor talks about making laws(policy) from the bench. This is not what the founding fathers intended for a judicial system. They had faced a corrupt judicial process in England and thought this branch of government should be the weakest of the three. An over reaching judiciary was a great fear of the founders.

While President Obama may remake the Supreme Court with radical judicial activists, the biggest concern now may be whether he is eligible to be President at all. The question of Obama's lack of a birth certificate continues. His vague answer about a national billboard campaign asking "where's the birth certificate" by Worldnetdaily.com was incredible. Obama said "it isn't a simple process." Excuse me? I had to have a birth certificate to get my drivers license and to get married, but he doesn't have to prove it to the American people that he was born in this country? The U.S. Constitution says a President must be "natural born" which implies birth within the borders of the U.S. or it's territories. Members of Obama's own family have said he was born in Kenya. His book details travels that he supposedly made as a young person and U.S. citizens were barred from travel to some of those countries. It appears that one only has to sign an affidavit declaring they are eligible and not prove it. The "certificate of live birth" from Hawaii doesn't count as many have been issued such a certificate but not actually born within the state.

What happens if, and I believe it will, the truth comes out? Will a democratic congress consider this "high crimes and misdemenors" and impeach him? Or, will a democratic controlled congress and a left-leaning court reinterpret the term "natural born." This could be a serious impending constitutional crisis. One that the media has almost totally ignored and, frankly, much of the so-called conservative talk media as well.

Sotomayor Nomination an Obama Slap at Second Amendment

BELLEVUE, WA – The nomination of Second Circuit Court Judge Sonia Sotomayor to replace retiring Justice David Souter on the U.S. Supreme Court is a slap at gun rights and the Second Amendment, the Second Amendment Foundation said today.Judge Sotomayor, a New York native, ruled on a Second Circuit Appeals Court panel that the Second Amendment is not a fundamental right and does not apply to the states in the case of Maloney v. Cuomo. This ruling is in direct conflict with a Ninth Circuit Court ruling in the Nordyke v. King case in California that the Second Amendment is incorporated through the due process clause of the Fourteenth Amendment.“While Democrats in Congress have been making great strides in the gun rights arena, refusing to consider a renewal of the Clinton gun ban, and offering overwhelming bipartisan support for legislation allowing citizens to carry firearms in national parks, President Obama just demonstrated that he prefers judges who oppose Second Amendment rights,” said SAF founder Alan M. Gottlieb.Incorporation may be taken up by the high court during its next session beginning in October, because attorneys in the Maloney case plan to appeal in late June.“If the Maloney appeal is accepted by the Supreme Court,” Gottlieb wondered, “would Justice Sotomayor – provided she is confirmed – recuse herself from deliberations?”Judge Sotomayor has written an opinion that declined to order the release of certain information under the Freedom of Information Act. In one case, according to SCOTUSblog, she wrote that the “unwarranted invasion of privacy” for individuals whose names would be release under an FOIA request outweighed the public interest.“Would a Justice Sotomayor be just as protective of the privacy rights of concealed carry permit holders if a newspaper wanted to publish that information,” Gottlieb asked. “We hope that during Senate confirmation hearings, someone asks about her positions on incorporation and the privacy rights of gun owners. The Second Amendment needs to be expanded, not eviscerated.”

President Obama's answer on this during his news conference was incredibly weak. There are "procedures to go through." This is the same guy who has been releasing classified information on our interrogations of terrorists. However, he just can't seem to prove that he is eligible to be President under our U.S. Constitution.

We are telling the automakers what cars to buy, the bankers who to lead money too, soon the newspapers what the write and limiting what can be said on the radio. Sounds at its best socialism.
