Thomas Jefferson(one of the founding fathers for you public school grads) once wrote that freedom is when the government fears us but TYRANNY was when we fear the government.  Recently, a Rasmussen poll indicated that 64% fear the government.  Jefferson also wrote that tyranny occurs when individual liberty is removed by the government.  There is no question that action by congress this week on the health care bill did that.  So, are we officially now facing a tyrannical government?   I think it is a fair question based on those hate mongers the founding fathers!

•According to data from the IRS, the bottom 50 percent of income earners pay approximately 4 percent of income taxes.
•The top 25 percent of income earners pay nearly 83 percent of the income tax burden, and the top 10 percent pay 65 percent.
•The top 1 percent of income earners pays almost 35 percent of all income taxes.
•The top 400 richest Americans [out of 320 million of us] paid 1.58 percent of total income taxes in 2000.
 
There are $500 Billion in tax increases in the Obamacare family of bills.  The largest tax increase in American history.

The Obama administration today is telling lenders to limit the monthly mortgage costs of those who can't afford the payment. Isn't this what got us into the mess in the first place?  I asked Bill Glynn who often appears on my programs to give his thoughts today about what is going on.  Here is his response:

Well the program perpetually is targeted at the under middle class – the original program failed to meet the target audience although it was up to750k homes. The program clearly needs to include higher end homes (the majority that are underwater) or there will be a massive forthcoming implosion there for certain. In addition allocating money this way is another borrow to spend program that further denigrates our image to the world and expand the federal government with infrastructure and new hires. The healthcare program and others are designed in such a way that the government can begin putting people back to work and providing relief both of which are very dangerous conservatively but clearly there are and will be programs introduced to hedge the declining attractiveness of their party. Remember the bigger the lie the more believable – hence things like the $200b doctor fix was left out of the bill – to misrepresent the CBO numbers and we all know those numbers are predicated on the future prosperity of our nation. The healthcare alone will be $3 trillion and NOW the KEY - immediately get people (fickle Americans) to focus on other things and replace the headlines with threats to leaders, name calling etc.. while the bill was passed - again get attention on something else and this again is a clear way and there will be more to get Americans looking the other way. The Industrial Political Entertainment Complex – and media is the most powerful weapon in the 21st century is fully engaged at giving Americans their opinions. Again if they want your opinion they are happy to give it to you.

Net Tax Hikes in Health Reconciliation Bill

The U.S. Senate today will begin consideration of H.R. 4872, the “Reconciliation Act of 2010.” It makes several changes to the healthcare law signed by President Obama today. Below are the tax changes made by the reconciliation bill to current law:
1. Creation of a new, 3.8 percent surtax on investment income earned in households making at least $250,000 ($200,000 single). This would result in the following top tax rates on investment income (Tax hike of $123 billion):

*Other unearned income includes (for surtax purposes) gross income from interest, annuities, royalties, net rents, and passive income in partnerships and Subchapter-S corporations. It does not include municipal bond interest or life insurance proceeds, since those do not add to gross income. It does not include active trade or business income, fair market value sales of ownership in pass-through entities, or distributions from retirement plans. The 3.8% surtax does not apply to non-resident aliens.
2. Increase the employer mandate tax from $750 per employee to $2000 per employee (disregarding the first 30 employees). This tax would apply to any employer who does not offer insurance and who has at least one employee eligible for a tax credit to purchase insurance inside the exchange. If any employee actually receives coverage through the exchange, the penalty on the employer for that employee rises to $3000. (Tax increase of $26 billion when combined with individual mandate)

3. Increase the individual mandate tax from the greater of 2% of adjusted gross income (AGI) or a dollar amount to the greater of the following (See employer mandate score):

2014 1% AGI/$95 1% AGI/$190 1% AGI/$285
2015 2% AGI/$325 2% AGI/$650 2% AGI/$975
2016 + 2.5% AGI/$695 2.5% AGI/$1390 2.5% AGI/$2085

4. Decrease Cadillac plan excise tax by delaying the implementation date from 2013 to 2018. It also increases the threshold for this 40% excise tax from $8500 single/$23,000 family to $10,200 single/$27,500 family. (Tax reduction of $117 billion)

5. Delays “Special Needs Kids Tax” (FSA Cap) until 2013. Delays the $2500 FSA cap (2011 under current law) until 2013. This provision delays the $2500 cap called for in the healthcare bill signed by the President. It will fall most-heavily on parents who use their FSAs to pay for expensive special-needs tuition pre-tax. (Tax reduction of $1 billion)

6. Raises “PhRMA Tax” from $22.2 billion to $27 billion from 2010-2019 (Tax hike of $4.8 billion). This is a simple money-grab from the pharmaceutical industry.

7. Changes medical device manufacturing excise tax from flat dollar amount to 2.9 percent excise tax (Tax hike of $800 million). This switches the money-grab in this industry from a dollar amount to a more conventional excise tax.

8. Raises health insurance tax from $59.6 billion to $60.1 billion from 2010-2019 (Tax hike of $500 million). This is a simple money-grab from the health insurance industry.

9. Delays tax hike on employer-provided retiree Rx drug coverage from 2011 to 2013 (Tax cut of $900 million). Under the bill the President signed, employers who provide retiree prescription drug coverage in coordination with Medicare would no longer be able to deduct their costs as a business expense. This moves forward that tax hike.
10. “Black liquor” tax hike (Tax hike of $23.6 billion). This is a tax increase on a type of bio-fuel.

11. Codification of the “economic substance doctrine” (Tax hike of $4.5 billion). This provision allows the IRS to disallow completely-legal tax deductions and other legal tax-minimizing plans just because the IRS deems that the action lacks “substance” and is merely intended to reduce taxes owed.

12. Exchange premium credits made more generous (Tax cut of $1 billion). This is more statistical scoring noise than anything else.

13. Associated effects on tax revenues (Tax cut of $11 billion).

TOTAL Net Tax Hike Effect: $52.3 billion/10 years

David Frumm and Talk Radio

Former George Bush speechwriter David Frumm is blaming talk radio for the health care fiasco this week. Claiming that we made it impossible for republicans to deal with President Obama.  Frumm's analysis on talk radio is as flawed as much of his advice to President Bush during the Bush Presidency. Frumm, who is definied as a neo-con, has a philosophy that is different than the traditional conservatism of Ronald Reagan.  You do not deal with the devil(s).   Did Frumm not learn any thing on how many times President Bush was burned in trying to cozy up to democrats?    Frumm wasn't that successful in providing President Bush good advice (i.e. use of US military)  and he better let us in the business analyze talk radio.  Talk radio is successful when we are in touch with the listeners

  One media writer agreeing with Frumm lamented that the format is focused on anger. Not so.It is the only vehicle left for the American people to voice their true opinion where the elitists do not have full control.  So, not surprising that elites, in the media and body politic, would not like the current structure.  It is this disconnect by some who came to be in charge of these talk radio stations as to why many stations are suffering.  They didn't like talk radio, or the audience,  and rather than serve them they chose to try and change it.    That same writer once wrote that the best talk radio he ever heard was about some guy talking about whether to "trim his pubes."  That is what I'm talking about.  Look at the track record of those who think talk radio should be the chit-chat you can find any where on  some morning zoo(if they aren't voicetracking) and you'll see a lot of radio debris.  The best talk radio is tapping into the mood of the listeners and serving them to the best of our ability.

The Politics of Health Care Reform (as of March 19, 2010)


By Matt Burke


With a possible vote on health care reform scheduled for the House this weekend, let us evaluate the political ramifications of such a vote.
At the beginning of the year, I offered that the 2010 Elections would net a 25-30 seat gain for Republicans in the House and 5-6 seats in the Senate. Based on the results of Scott Brown’s victory in Massachusetts and the health care cram down, those numbers need to be reevaluated.


Right now, a firm majority of Americans do not support the current health care legislation (52-55%). In spite of these numbers, I do predict that the Democratic Congress will pass health care reform this weekend. I do not think the “Slaughter Rule”, aka the “Deem and Pass” will be needed, and the Senate bill will pass in the House, and then the proposed reconciliation package for the House will pass. The fight will not be over, as the Senate now wants to have their own reconciliation bill, which will have to be voted on in the Senate and passed by the House. Does your head hurt yet?


But, once the House passes the Senate bill (not the reconciliation), that will be presented to the President for signature, and it becomes law.
I once heard that a definition of tyranny is when the majority is ruled by the minority. With over half the population not supporting this bill, what is happening clearly meets that definition.


Thankfully, we live in a democracy where voters can express their opinions of their elected leaders.


If the elections were to be held now, I think we would see a 38-45 seat gain for the Republicans in the House, with up to a 60 seat gain possible. I also expect wins for the Republicans in the Senate races in Colorado, Delaware, Arkansas, Indiana, North Dakota, and Nevada—all seats currently held by Democrats. Also in play are the Democratic seats in Illinois, Wisconsin, New York, California, Washington and Connecticut. Right now, a 50-50 Senate is very much in play.


But there is a more important election being held in 2010 than the one for the Federal Offices. As this is a census year, the state legislatures that will be voted in will be drawing the new Congressional district lines based on reapportionment. Current predictions are that Republican leading states will gain ten more Congressional districts, with traditional Democrat states naturally losing ten. Texas is expected to be the big winner.


If Republican states also have Republican state legislatures, they can ensure that those ten new Congressional districts will be Republican districts.


Even more vital is that the Electoral College is based on Congressional districts, so this means about ten less Electoral College votes for President Obama in 2012. If the election were held today, President Obama would lose by a wide margin, by a similar result to the 2008 election, having lost such pickups as Virginia, North Carolina, Florida and Ohio.


By paying for health care reform by reducing Medicare benefits, Obama and the Democrats have also garnered the wrath of the senior population. While the Dems won in 2006 and 2008 based on the youth vote, that was only possible because the senior vote was split in those years. The seniors are the voters that are strongly opposed to the current health care reform, and they will vote in 2010 and beyond against any cuts to Medicare. The Democrats may have lost a generation of senior voters, once a bedrock constituency.


Legally, there are many challenges that can be made, but until we know what the final package is going to be, we do not know where to attack. There is certainly an equal protection argument to be made (costs are spread unequally amongst the states), plus a due process argument (can Congress impose a fine just because you are born?). Any successful Supreme Court argument will not only focus on health care, but on the general argument of “Does Congress, under Article One, have the authority to do this?” For if they do, then we are no longer a government of limited powers, but one that can regulate every aspect of out lives.


Currently, there are 40 Democratic Congressman that state they are undecided. Unfortunately, I fear the reason why some of them are undecided is that they are looking for sweetheart deals for their vote, similar to the Cornhusker Kickback and the Louisiana Purchase. It is because of this that I fear the health care reform legislation will pass. These Congressmen have to know their election chances are doomed and are doing their best to preserve their legacy.


Last weekend I watched a documentary about the closing days of WWII in the Pacific. The Japanese Navy was decimated, and the only way they could attack our navy was to launch kamikaze attacks on our ships. These pilots were sacrificed for a cause that was known to be lost, with promises of eternal glory in the afterlife. While just a footnote to the war, these kamikaze pilots inflicted great damage on our naval forces, having destroyed about 38 ships.


These Democratic Congressmen are also on a kamikaze mission, and their effect is to inflict great damage on our health care system

HOW CAN I BREAK INTO RADIO?

I have been asked this question since I got my first part-time job in radio at WZEZ-FM/Nashville in 1981.  Al Peterson in his NTS Aircheck posted this about talk host Laura Ingraham:

That question was posed to Talk Radio Network host Laura Ingraham by a recent college graduate in an online sneak peek from a soon-to-be-regular series for “Laura365″ members. “I think the way to be a success in the media is to do something else first,” replied Ingraham (pictured). “I think you have to first be successful in another area of life. You’ll bring more to the table when you have some experience outside the media first.” Prior to her radio career, Ingraham was a lawyer, a White House speech writer during the final two years of Ronald Reagan’s administration, and a law clerk for U.S. Supreme Court Justice Clarence Thomas. “All of that experience gave me a different take on things and, I believe, made me a better talk host,”

While I understand Laura's comment, I must say it is the consultant babble we get in the business these days.  In my experience as programmer and host, some of the best personalities were the people who actually had a love for the medium first. Today, it seems cool to have people who just "fell" into the business or media in general.  Some of the most well rounded are radio people because their "life experience" is interacting with the average person on the street. 

The correct answer is that LOCAL hosts make the best personalities because they talk about what is happening in a given community or area.  They live and shop in the area. Their kids attend the local schools or attend community events.    Today, unfortunately, in a mostly syndicated talk show world, the personalities are lawyers, politicians, or comedians.   Not people who can RELATE to the audience.   We wonder why radio, and talk radio too, are not showing growth, it is because we are not doing the basic thing of survival.  SERVE your audience. Don't try to change it.  SERVE them.  Too many managers really do not like the talk radio audience to begin with and therefore, want to change it.   By doing so, they fail to serve the audience and the audience leaves.

By switching mainly to these syndicated shows, the listener gets similar rantings from those who live in DC and NYC.  We have totally discounted the valuable asset of having local talk so that callers of the radio station can voice what they think--whether it is national or local.    Don't know about you, but most of the stations I work with could care less what some caller to a national show thinks.    Now that we in the days of PPM, we might better get back to understanding that someone who calls a radio station is likely a passionate listener as well.  When they call and are heard on the air by their friends they are likely to stay with the station longer and may be talk their friends into listening.  Does this happen when someone from Wisconsin calls into one of the many syundicated shows?  I doubt it.

There are many great talk stations out there where local hosts are still serving the audience providing the best chance for ratings and revenue.

Instead, this is kind of what I'm hearing a lot:

  • All or nearly all syndication.  No local branding.  No opportunity for the audience to bond with a local personality.
  • An attempt to make the format more "hip" or "female friendly."  What we forget is that the talk radio audience is looking for people of substance talking about substance.  They can get the FM type chit-chat about pop culture anywhere on the dial.  If pop culture, aka Tiger Woods, becomes the predominant topic, talk radio handles it.
  • One host that tells you to cut up your credit cards and get a job.  Everone who calls in is up to their eyeballs in debt.  Host tells them not to buy any thing.  Not sure how that kind of talk attracts the typical talk radio listener who is affluent(not in debt).  Radio is in business to sell ads so having a host who is consistently telling people not to buy is counter productive in my opinion.
However, when you look at the heritage stations.  Many have a good mix of local and syndicated shows and are very successful in ratings and revenue in this downturn.  Small businesses are looking for an economical way to advertise but they want a local personality to do the pitching.  If there isn't one or more than one, it is a tough sell to them.

I read one former programmer who wrote that the best talk radio he ever heard was some guy talking about whether to "trim his pubes."   The best talk radio I've ever heard was local hosts and their handling of the 911 attacks.  Couple that with the numerous instances of the weather impact on a local community or some local emergency where radio responded.  Let the guy who wants to talk about his "pubes" find him a morning zoo to host.

The Health care debate will be center stage this week.  President Obama is intent on passing health care despite opposition by the American people.  It is imperative that we stop this bill for the good of our decendants to come.  Never has this country faced such a massive loss of freedom.

Perry wins republican nomination in Texas Gov. Race

If Perry wins re-election, and he will be favored, over the democratic challenger, then people will have to begin discussing whether he should take his message on a national stage.   He will have been Texas Gov since 2000 and a track record of conservative values.

Today is the 173rd anniversary of Texas declaring its independence from Mexico and tonight the results are being counted in the statewide republican and democratic primary.

  • Governor Perry doing well and might avoid a runoff.  What does this mean?
  • Does it mean that even a popular Senator like Kay Bailey Hutchenson can't get away from being a member of a very unpopular congress?
  • Does it mean that the tea party candidate Debra Medina's mis-step with Glen Beck mortally wounded her chances?

  • Poll this past week suggested that over 56% of American's no longer trust the federal government.  Could this be factored into the Texas election?   Governor Perry did float the "succession" idea and KBH is considered a Washington insider.
  • One caller on WOAI tonight suggested that he had to move from Texas because of the "tyranny" here.  Good point made by Joe Paggs..."what state has less "tyranny" thank Texas?"

  • Supreme court is again hearing the Chicago gun ban.  This is one reason why so many Americans are becoming paranoid about the federal government.  We have to keep having constitutional rights fought in the courts.

Governor Rick Perry is likely to get most of the votes but the issue is whether he will get enough to avoid a run-off versus either Sen. Kay Bailey Hutchenson or Debra Medina.   Some Medina comments during the campaign caught attention and the ire of some conservatives including talk show host Glen Beck. Beck has been a strong supporter of the tea party movement and many are supporting Medina's candidancy.   Joe Paggs takes calls from 6-10pm et and I'll talk over at 10pm et.

  • My latest theory on why the dems are going ahead with health care despite anger from voters is that the democratic leadership believes the voting public will reward them later.  Yes, some dems might lose their jobs in the next election but eventually the electorate will like government run healthcare.  I'm not sure they are correct in this but it makes stopping this more difficult.
  •  Tennessee Senator Lamar Alexander did well in repeating President Obama's words against him during the health care summit.
