7:05am Matt Burke...legal scholar and involved in conservative politics...will join me to discuss several issues including the Sonia Sotomayor nomination to the U.S. Supreme court. Here are some of our talking points:
1. The Senate has moved her confirmation to July, which is not necessary. The Supreme Court is out of session from July 1- First Monday in October, so no work will be missed. I think there are a couple of reasons for this; first, they do not want any more troubling information to come out; second, this summer will also be filled with challenging votes and debate on cap and trade and health care, not to mention the budget, which may include tax increases. This might be a big distraction to cover everything else.
2. It will be interesting to see how the Supreme Court rules on the Ricci case. I expect it to be a split decision, so it will be interesting to read the decision of the side that disagreed with her ruling, whether it is the majority or dissent. Justice Thomas is usually the author of EEO decisions, given his experience there, so expect his to write either the majority or the dissent. What will be interesting is if Scalia or Alito write their own separate decision that criticizes Soto. The justices will never publicly criticize a nominee, but they can attack her legal reasoning, and this would be a wonderful way to do so.
3. President Obama's administration is considering giving miranda rights to terrorists.
