Your Captain in the newly created Second Continental Army is ready for duty this morning at our the outpost known as Chattanooga! Why? Since the media is so afraid of the "dangerous" tea partiers, we need to give them an "army" to think about!
The Mexican President, and every Democrat in the United States is upset at the new Arizona immigration law. How about we just mirror the one that Mexico has and end this issue?
(from Human Events)
Oh, wait. They actually have the toughest immigration laws on the continent. According to Human Events, they even deport more people annually than the United States does.
Who could disagree with such a law? It makes perfect sense. The Mexican constitution strictly defines the rights of citizens — and the denial of many fundamental rights to non-citizens, illegal and illegal. Under the constitution, the Ley General de Población, or
General Law on Population, spells out specifically the country’s immigration policy.
It is an interesting law — and one that should cause us all to ask, Why is our great southern neighbor pushing us to water down our own immigration laws and policies, when its own immigration restrictions are the toughest on the continent? If a felony is a crime punishable by more than one year in prison, then Mexican law makes it a felony to be an illegal alien in Mexico.
If the United States adopted such statutes, Mexico no doubt would denounce it as a manifestation of American racism and bigotry.
… Foreigners who fail to obey the rules will be fined, deported, and/or imprisoned as felons:
•Foreigners who fail to obey a deportation order are to be punished. (Article 117)
•Foreigners who are deported from Mexico and attempt to re-enter the country without authorization can be imprisoned for up to 10 years. (Article 118)
•Foreigners who violate the terms of their visa may be sentenced to up to six years in prison (Articles 119, 120 and 121). Foreigners who misrepresent the terms of their visa while in Mexico — such as working with out a permit — can also be imprisoned.
Under Mexican law, illegal immigration is a felony. The General Law on Population says,
•“A penalty of up to two years in prison and a fine of three hundred to five thousand pesos will be imposed on the foreigner who enters the country illegally.” (Article 123)
•Foreigners with legal immigration problems may be deported from Mexico instead of being imprisoned. (Article 125)
•Foreigners who “attempt against national sovereignty or security” will be deported. (Article 126)
Mexicans who help illegal aliens enter the country are themselves considered criminals under the law:
•A Mexican who marries a foreigner with the sole objective of helping the foreigner live in the country is subject to up to five years in prison. (Article 127)
•Shipping and airline companies that bring undocumented foreigners into Mexico will be fined. (Article 132)

Doug's Daily Briefing for Monday
There was an interesting discussion yesterday on the Fox News Sunday program between the Weekly Standard's Bill Krystal and NPR's Juan Williams. The exchange centered on emails from Goldman-Sachs released publically. Williams said that there is no privacy at work at your "Boss" has a right to read them. The Boss he was referring too was the government. As Bill Krystal pointed out, this was a telling statement on the view the left has. The governmnent is not our hired hands, they are our BOSSES. It is this type of view that is leading much of the so-called progressive movement of today. As Ronald Reagan once said, there is a battle about whether we have a right to govern ourselves or some intellectual elite in Washington govern us. Who do you think is winning right now? Remember, the current President called the U.S. Constitution one time "a collection of negative liberties."

From the Media Research Center another example of the media distortion about what our founding fathers believed about religion. It shows how far this country has fallen when it is a controversial statement in America to say this is a "Christian Nation." Whether you think it truly is or not, better than 90% of Americans say they are Christian. No other religion, including non-religion makes up even 10%.
ABC Self-Generates 'Controversy' Over Palin's Innocuous 'Christian Nation' Remark By: Brent Baker April 21, 2010 09:10 ET
Horror of horrors, at least to ABC, last week Sarah Palin suggested the U.S. is a “Christian nation,” hardly an unusual presumption, but the network discovered “controversy” as anchor Diane Sawyer announced: “Tonight, a question about religion and America, occasioned by comments by Sarah Palin that are getting a lot of attention.”
A lot of attention from liberal groups with a specific agenda on the subject, a fact left out of the World News story, but revealed in an ABCNews.com article which led with how “two groups dedicated to the separation of church and state are now speaking out against her, arguing that she is misreading the founders' intent.”
Dan Harris began his Tuesday report: “This latest Palin-provoked controversy is the result of these comments on YouTube.” Palin, in poor-quality bouncing video, could be heard saying “God truly has shed his grace on thee, on this country.” Harris quoted Palin as asserting it is “mindboggling to suggest that America is not a Christian nation.” He countered: “Mainstream historians say no, that if you look at the early documents, including personal letters, it's very clear that the founders did not want to make Christianity the official religion.”
Palin, however, never said anything about an “official” religion, so could just mean that as a practical matter the nation is Christian since it was founded on Christian principles espoused the majority of the Founding Fathers, that nearly all current elected officials pay homage to Christianity no matter their level of faith and that the vast majority of Americans who are religious adhere to a Christian faith.
Nonetheless, Harris pursued his case against Palin: “The Founders left out any mention of God or Jesus in the Constitution” and “then in the First Amendment, they specifically outlawed the establishment of any state religion. And, by the way, Thomas Jefferson, the man who wrote in the Declaration of Independence that ‘we are endowed by our Creator with certain unalienable rights,’ he was a deist, not a Christian.”
Even assuming Harris’ history lesson is accurate and Palin has misunderstood the founders, what explains ABC’s news judgment to turn some bad video on YouTube, seen by few, into a network news story? It seems to reflect mainstream media obsession with Palin, never wanting to miss a chance to ridicule her.
The online posting, “Sarah Palin's 'Christian Nation' Remarks Spark Debate: Advocates of Church-State Separation Say Palin Is Distorting Founders' Intent,” highlighted how ABC was doing the bidding of particular political activists:
Is America a Christian nation?
Sarah Palin said on Friday that it's "mind-boggling" to suggest otherwise.
But two groups dedicated to the separation of church and state are now speaking out against her, arguing that she is misreading the founders' intent.
"It's incredibly hypocritical that Sarah Palin, who disapproves of government involvement in just about anything, now suddenly wants the government to help people be religious," Barry Lynn, the executive director of Americans United for Separation of Church and State, told ABC News...
The other group: something called the “Secular Coalition for America.”
If only obscure conservative groups could prompt ABC News stories by complaining about things liberal politicians say that they don’t like.
The story on the Tuesday, April 20 World News on ABC, transcript provided by the MRC’s Brad Wilmouth:
DIANE SAWYER: Tonight, a question about religion and America, occasioned by comments by Sarah Palin that are getting a lot of attention. And here is the question: Should America be defined as a Christian nation? Dan Harris on the response.
DAN HARRIS: This latest Palin-provoked controversy is the result of these comments on YouTube-
FORMER GOVERNOR SARAH PALIN (R-AK): God truly has shed his grace on thee, on this country.
HARRIS: -in which the former Alaskan Governor said it is, quote, "mindboggling to suggest that America is not a Christian nation."
PALIN: Lest anyone try to convince you that God should be separated from the states, our Founding Fathers, they were believers.
HARRIS: The idea that America was founded as an explicitly Christian country is an article of faith in some circles. The Fox News host Glenn Beck has dedicated entire shows to it.
UNIDENTIFIED MAN FROM FNC'S GLENN BECK SHOW CLIP #1: When they looked at all the writings the fathers used and relied on and quoted-
UNIDENTIFIED MAN CLIP #2: -the most quoted source was the Bible.
HARRIS: So is this argument correct? Mainstream historians say no, that if you look at the early documents, including personal letters, it's very clear that the founders did not want to make Christianity the official religion.
PROFESSOR EMERITUS MARTIN MARTY, UNIVERSITY OF CHICAGO DIVINITY SCHOOL: Most of the Founders were members of Christian churches, and their tradition was biblical and Christian, but they took great pains to avoid tilting the government toward religion.
HARRIS: The Founders left out any mention of God or Jesus in the Constitution, except when they noted the date in the Year of Our Lord, 1787. And then in the First Amendment, they specifically outlawed the establishment of any state religion. And, by the way, Thomas Jefferson, the man who wrote in the Declaration of Independence that "we are endowed by our Creator with certain unalienable rights," he was a deist, not a Christian, meaning he believed that God created the universe, but no longer intervenes in human affairs.
Interestingly, however, many people believe that by not making Christianity the official religion, the Founders created a dynamic and competitive atmosphere in which faith has thrived, making America one of the most religious developed countries on Earth. Dan Harris, ABC News, New York.

Great read today from Andrew Klavan regarding the new media. Mainstream media types this week have fretted about lack of "filters" and one even called internet journalism "terrorism."
3:35p Andrew will be on with me on WAPI FM.
Washington Post columnist said on Face the Nation last Sunday that internet journalism (because it doesn't have that liberal editor filter) is like "terrorism." See it for yourself.
Here is another one for you. When libs get together they talk to other libs like on the Chris Matthew's weekly show on NBC. Here, lib Joe Klein says comments made by Sarah Palin and Glen Beck are close to being "seditious."
I've got one for you Joe. How about what Thomas Jefferson said about "tyranny." Jefferson said "Tyranny was when the people FEAR the government." Well, a few weeks ago, a Rasmussen poll had 64% of Americans saying they FEAR the government. This week, the Pew Research poll showed an 80% majority do not TRUST the government. So, which is closer? Palin and Beck committing "sedition" or the current politics leading us toward "tyranny?" You figure it out.
Former Colorado Congressman Tom Tancredo who has been a champion on the issue of illegal immigration told an audience in Greenville, SC this past weekend during a tea party rally that we should send "Obama back to Kenya." He based his comments on Michelle Obama's recorded words that she and Barack went back and visited "Barack's home country." Which is it? If Kenya is B.O's home country, then he is not eligible to be President under the "natural born clause" of the U.S. Constitution.
Of course, the brilliant are in the U.S. Senate.
Story out of Washington today says Iranian missile could hit US by 2015. We saw the President act irresponsibly last week in the so-called Nuclear Summit. All that was going on was a planned "ambush" of Israel's nuclear weapons program by the Obama administration and islamic nations. Fortunately, Israel Prime Minister Benjamin Netanyahu bailed out of it before the ambush happened. We will be talking about the move away from supporting Israel by this administration and the concern of a nuclear Iran.
Two guests today on those subjects.
4:35pm et. James Hutchens. He was the first U.S. chaplain ever wounded in Vietnam. He is President of JerUSAleum connection.

(Reprinted WITHOUT permssion from my buddy Steve Gill's website) The left keeps saying the tea partiers are all abunch of white people who are likely "racists." Steve pointed out at his web site http://www.gillreport.com/ that Michelle Malkin's column takes issue with the New York Times doing it. You see, the entire editorial board of the New York Times is white!

Show Outline:
3:35p et. Wayne Allyn Root will join me to discuss the tea party movement and the comments by the left that these are "dangerous" people. Does this woman look dangerous to you?
Wayne is a former Libertarian candidate for Vice-President and writes the daily blog at
http://www.rootforamerica.com/. He recently spoke at the Nevada Tea Party rally.
4:05p et Jim Kouri...Vice-Presdient National Association of Chiefs of Police will be on the show to further discuss how "dangerous" these tea partiers are. It is the 15th anniversary of the Oklahoma City bombing and the left is trying to connect today's anti-government sentiments to violence. Jim also writes a daily column for examiner.com (and links to his latest columns are on the right side of this page).
5:05p Matt Burke...a lawyer and involved in republican party politics. Matt will be on with me to discuss these issues:
1. A Distict Judge last week ruled the national day of prayer "unconstitutional."
2. A Christian group on campus fights to be recognized as other groups are.
3. The NRA is sitting on the sidelines in the gun debate in Alabama and with other states. Why?
4. Alabama's legislature has failed so far in passing a bill that would allow the state to opt OUT of Obamacare.
5. President Obama's Supreme Court nominee. Should we be scared?
Does this Lady look dangerous to you?
This must be one of the tea partiers that former President Bill Clinton and the current administration think is dangerous.

SHOW OUTLINE:
3:35p et. Lawyer Matt Burke will join me to discuss several issues including the new Supreme Court nominee, the adminstration wanting to read our emails WITHOUT a warrant, and a federal judge's decision that says the "National Day of Prayer" is unconstitutional.(Matt's thoughts on the Supreme Court issue posted below.
4:05p et. Gary Rathbun on financial news of the day with "After the Bell' from Private Wealth Consultants.
How can a Judge rule the National Day of Prayer Unconstitutional?
What to watch for in Obama's Supreme Court pick
Department of Justice wants to read our emails without a warrant. In other words, they are fishing.
FBI chief says "home grown terrorists" are bigger threat than Al Qaeda. I have to ask, is he talking about the tea party movement?
White NBC reporter confronts black man at tea party and asks him "have you felt uncomfortable?"
Matt Burke's thoughts on Obama's Supreme decision:
What to watch for in Obama's Supreme Court pick
It will be interesting to see who Obama selects to replace the retiring Justice Stevens. To keep it simple for everyone, there is only one name to remember- Merrick Garland. Judge Garland is considered moderately liberal who supervised the Oklahoma City bombing trials in the Clinton administration. He is considered to be to the right on executive power and criminal defense, but trends towards the left on environmental issues.
The reason I say only remember him is that his selection will signal to me how politically vulnerable Obama is with his left wing base. The left wing would clearly prefer a different nominee, such as Diane Wood or Elena Kagan, as would Obama personally. If the President thinks he needs to appeal to the majority of the electorate, then he selects Garland--if he thinks he needs to shore up his base, he looks elsewhere.
What I would like to ask a potential nominee
The Senate usually spend two days grilling Supreme Court nominees asking ridiculous questions. Any savvy observer knows that a nominee will not answer questions about specific issues, and have been well trained on how to avoid directly answering the questions posed. Here are some questions that will be answered, and will provide a great insight as to their judicial philosophy.
1. Name your five worst Supreme Court decisions. The reason I say five is that three decisions are universally despised (Dred Scott, Plessy, Korematsu), the last two will provide great insight. Conservatives would like to hear cases such as Wickard or Kelo, a liberal would like to hear Lopez, Bush v. Gore, or Citizens United.
2. What is the limit on Congress' commerce clause power? If there is a conflict between the text of the Constitution and an amendment, which prevails?
3. Article II states that the executive power shall be vested in a President. What does that mean to you?
4. What legal questions are you looking to have the court address in the future?
The most important issues to be addressed by the Court
Lots of ink and airtime will be spent to the nominee' stance on abortion. Even though I am personally pro-life, I do not believe that is even in the top five of issues that I would like the court to address. My top five are:
1. What is the limit on Congress' power? Are we going to fall under the Wickard standard, where Congress' power is virtually unlimited, or under Lopez, where limits are placed?
2. What are the President's wartime powers?
3. Are we going to continue to view eminent domain as the government can seize for public purpose, or are we going revert back to the text of the Constitution where it says public use?
4. Are the Ninth and Tenth Amendments dormant or active?
5. What is the limit on the authority of executive branch appointees who do not face Senate confirmation?

For those who think that those of us who are concerned about whether the President qualifies under the "natural born citizen" clause of the U.S. should go here for the NPR report in 2008. The report called Obama a "son of Africa" and "born in Kenya." For those who think it is nutty, remember that President Obama's grandmother and sister said he was born in Kenyan in previous interviews.
In another example of the left trying to control our behavior. Tennessee Medical Students are supporting a tax on sodas to "fight obesity." When will the left understand that issues like "obesity" are personal choices. The tax code is filled with taxes to influence our behavior from environmental issues to charity.
Chattanooga police discuss the gang issue during a public forum. Make sure the police and public are better armed!
Guns-in-bars bill reworked to withstand legal challenges. Why do you lose your right to defend yourself just because you go into a restaurant that also serves alcoholic beverages

Handgun-in-bars bill passes subcommittee in Nashville. Close vote. Why shouldn't legal permit holders be able to conceal carry any where?
More financial problems for the Chattanooga City Council.
Gas company wants increase and people oppose it. It is always amazing how we see price hikes in bad economy times, and that only makes the matter worse.
This one bugs me..and I'm no lawyer. A mother previously did abusive things to her daughter. However, those prior issues can't be brought up in court when she is on trial for neglect. I thought the judicial system was supposed to be based on "justice." My buddy and lawyer Matt Burke will join me to discuss this around 10:38am et.
Matt Burke wrote ..."The court decided to exclude evidence that Traci Carpenter repeatedly abused her child, which may have lead to the child's death. Her boyfriend has been acquitted of the crime of felony murder. The main reason for this is that the indictment on Carpenter was very narrow for the crime of aggravated child neglect, only including a 24 hour period. This was likely a tactical decision made by the prosecutor as the evidence may have been less than reliable.
Generally, such character evidence is inadmissible as it has a prejudicial impact on the case, and offers little probative value. These types of independent crimes or actions are only admissible if they show motive, intent, identity, or a similar plan or scheme (there are others, but these are the most common).
The main reason why the judge threw out these other acts was because the prosecutors never charged Traci Carpenter with these crimes. I suspect the reason why she was never charged with those crimes is that the evidence was not sufficient to get a guilty verdict, and was likely based on testimony from other drug users and other reprobates, testimony that would be destroyed by a defense attorney at trial.
If Traci Carpenter were to testify on her behalf at trial, and say that she was a good mother, or something like that, then the prosecution could offer rebuttal testimony about all of the other bad acts described above."
Live on KLIF/Dallas this afternoon 5-8p et
- Texas calculates how much Obamacare will cost the state's taxpayers.
- Premiums of young people will increase at least 17%
- Have you heard of a gas operated clock? The EPA listed that product as an energy saver. Only problem, it doesn't exist.
7pm et. Katherine Albrecht will join me. She is a talk show host and author of six books. Concerned about how privacy and what the government is doing to remove it.
